Proposals, Home Intelligence pages, Market Pulse, campaign pages, landlord portals, prepared contracts and letters of offer are reached by unique links sent to you. Keep them to yourself. Do not forward a link that shows another person's information. We may require a one-time code on a new device and may disable a link that appears to be shared.
Proposals, appraisals and estimates
A price or rent appraisal is the agent's opinion, formed from comparable evidence and market data at the date shown, and is not a valuation or a guarantee of a sale price or rent. Market data, forecasts, cost-benefit and scenario tools are indicative, depend on their inputs and assumptions, and are not financial, legal, tax or investment advice. Obtain your own advice before acting.
Agency agreements and electronic signing
Where you accept a proposal and sign an agency agreement electronically, you consent to electronic signing under the Electronic Transactions Act 1999 (Cth) and the corresponding state Acts. You will receive the executed agreement by email. Statutory cooling-off rights and the right to seek independent advice before signing are not affected.
Contracts of sale and letters of offer
A prepared contract of sale shown on this platform is for information and for your legal representative's review. A letter of offer submitted through the platform is an expression of your offer and its proposed terms; it is not a binding contract. A contract for the sale of land comes into existence only when the contract is signed by both parties and exchanged. Offers are presented to the vendor as the agent judges appropriate and the vendor may accept, counter, decline or ignore any offer. Drafts you save are visible to the agent, and in aggregate to the vendor, as described in the Privacy Policy.
Deposits
Deposit holder details are shown only on the prepared contract page and confirmed by phone on the office landline before any payment. We never change bank details by email. If you receive bank details by email or SMS, do not pay until you have phoned the office on the number on our website.
Open-home check-ins
By checking in you confirm the details are yours and agree that we may contact you about this property and similar ones. You can opt out at any time.
Portals, suppliers and third parties
Listings syndicate to realestate.com.au, Domain and our website under those sites' own terms. Supplier services are delivered under the supplier's terms; we pass on supplier costs as quoted in the proposal.
Acceptable use
Do not attempt to access another person's page, scrape the platform, interfere with it or submit false information, offers or identities. We may suspend access and refer conduct to the authorities.
Liability
To the extent permitted by law, including the Australian Consumer Law guarantees that cannot be excluded, T.G. Newton is not liable for loss arising from reliance on an appraisal, estimate, forecast or market data, from a supplier's or portal's service, or from an interruption to the platform. Nothing in these terms limits a right you have under the Property Agents and Land Transactions Act 2016 (Tas) or the Estate Agents Act 1980 (Vic).
Governing law
These terms are governed by the law of the state in which the property is located and the courts of that state.
